In (2010) 16 JML, Eftestöl-Wilhelmsson considers the Rotterdam Rules' solution of a 'mandatory modified network liability system' in light of the European Commission's attempt to establish a European regional instrument on multimodal carrier liability.

"Whether or not the Rotterdam Rules provide a sufficiently effective alternative to the European Commission's objective to see increased use of multimodal transport by providing transport users with a predictable liability system is debatable; it is arguable that despite the incompleteness of the Rotterdam Rules on multimodal carrier liability, the European Commission should not try to navigate around them but rather accept the modified network liability system as a sufficient alternative."
